Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1) points 1–4 of the Public Procurement Act apply. These include, among other things, convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or financing of terrorism; enabling illegal employment of a foreign national or violating wage requirements; illegal use of child labour or human trafficking; and tax, fee or environmental charge arrears, or social security contribution arrears.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register or another equivalent register in its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the data itself. The bidder and/or its subcontractor must have completed at least one contract similar to the subject of the tender within the 36 months preceding the start of the procurement and must submit a list of such contracts with information on their value, dates and the other contracting parties. The bidder and/or its subcontractor must also confirm that its technical equipment is sufficient for performing the works covered by this tender. The bid must comply with all conditions set out in the procurement documents, and conditional bids are not allowed. The cost and expense calculation for the works must also be submitted on the form titled “Calculation”.
