Compliance requirements

The bidder may be excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or otherwise in a similar situation under the law of its country of establishment. The bidder may also be excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after receiving notice of the exclusion ground. The notice also requires confirmations that the bidder has no exclusion grounds under the Public Procurement Act sections 95(1)(1)–(3) and (5), that the bidder is not linked to the technical consultant advising on the apartment building reconstruction, and that the average wage of the bidder’s employees is not below 70% of the average wage in the relevant sector during the reference period. If the required evidence cannot be checked from public registers, the bidder must submit documents proving the absence of exclusion grounds within 10 calendar days.

Qualification criteria and exclusion grounds

The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, but they must prove their competence with an equivalent document. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value, excluding VAT. The exact amount must be entered to the nearest 1 euro. The bidder must confirm that it can provide, by the contract signing date at the latest, a performance bond confirmed by a credit or financial institution in the amount of 5% of the contract value. The bond must remain valid throughout the construction period; depositing the corresponding amount into the beneficiary’s or a notary’s account is also accepted, provided that the beneficiary remains the entitled party throughout the construction period. The bidder must provide details of at least one equivalent construction project carried out within the 60 months before the start of the procurement procedure. An equivalent project must be the construction of a building, an extension, or a full-building reconstruction as the main contractor, and it must include at least the construction or reconstruction of the load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, or the construction or reconstruction of a new heating system. The submission must state the project name, building details, execution period and value. The bidder’s team must include at least a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence. The required qualifications are specific: the project manager must have either a level 6 construction engineer or construction manager qualification, the site manager a level 5 construction works supervisor qualification, the ventilation and heating systems specialist the relevant level 6 professional competences or a level 6 construction manager qualification, the water supply and sewerage specialist the relevant level 6 professional competences or a level 6 construction manager qualification, and for electrical works a B-class competence certificate or a level 6 electrical engineer qualification for consumer electrical installations. If the bidder relies on the capacities of other persons, signed confirmations of their participation in contract performance must be attached.
