Compliance requirements

The machine-readable notice included exclusion grounds. The bidder is excluded if it is bankrupt or in liquidation, if insolvency or liquidation proceedings have been opened, if business activity is suspended, or if it is in a similar situation under the law of its country of establishment. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred, paid, or is being paid/deferred within 10 calendar days after notice. The notice also refers to the general exclusion grounds under Section 95(1)(1–3 and 5) of the Public Procurement Act, as applicable. The bidder must confirm that these grounds do not apply and, if requested, submit evidence. The bidder and the technical consultant advising on the apartment building reconstruction must not be related persons. If the bidder cannot prove the absence of exclusion grounds from public registers, the contracting authority may request documents within 10 calendar days.

Qualification criteria and exclusion grounds

The machine-readable notice included qualification and compliance requirements. The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and building internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a business activity notice for electrical works covering construction and installation of electrical installations. Foreign bidders may prove equivalent competence with equivalent evidence instead of local registration. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least twice the estimated contract value, entered as a specific amount with 1-euro precision. The bidder must be able to provide a performance security equal to 5% of the contract value by the contract signing date, or within 10 calendar days after signing if the contract is signed earlier; a deposit to the beneficiary’s or notary’s account is also accepted if the beneficiary remains entitled throughout the construction period. The bidder must have completed at least one equivalent construction project within the last 60 months before the start of the procedure, with a value of at least half of the estimated contract value. An equivalent project means building erection, extension, or full-building reconstruction as the main contractor, and it must have included at least structural and external envelope works, heat-recovery ventilation works, or a new heating system. The team must include a project manager, site manager, ventilation and heating specialist, water supply and sewerage specialist, and, if electrical works are performed, a person with at least B-class competence certificate or electrical engineer qualification at level 6.
