Compliance requirements
The bidder must be excluded if a mandatory exclusion ground applies to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder: participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorist offences, money laundering or terrorist financing; enabling the employment of a foreign national staying in the country illegally or violating the conditions for employing a foreign national; illegal use of child labour or human trafficking; or tax, levy, environmental charge, or social security contribution arrears. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached an earlier public contract, or if it has submitted false information about qualification or failed to provide required data and documents. The bidder must confirm that none of these grounds apply. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months preceding the start of the procurement, at least three properly performed electrical construction contracts similar to the subject of the contract. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. On request, the contracting authority must be provided with evidence of proper performance of the similar electrical construction contracts, unless the authority can obtain the information from public or its own databases without significant cost. In addition, the bidder’s team must include a person with valid switching authorisations who has been entered into the Elektrilevi partner portal before the deadline for submission of tenders, a person appointed as responsible for work operations who has also been entered into the portal before the deadline, and a leading electrical works person who has valid A-competence or at least level 6 vocational qualification and the relevant proof at the time of submission of the tender. The bidder must also provide the names and contact details of the contract signatory and the contact person for contract performance matters, and a power of attorney if required. The tender must include the pricing table and fully comply with the tender documents. The machine-readable notice did not include precise other qualification or compliance requirements; these must be checked in the tender documents.
