Compliance requirements

The bidder must not be subject to the mandatory exclusion grounds: conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; conviction for enabling illegal employment or violating the conditions for the employment of a foreign national; conviction for illegal use of child labour or human trafficking; and tax, fee or environmental charge arrears. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous contract, or that has submitted false information about qualification or failed to provide the required information and documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, and, in public procurement cases, the reference numbers; the contracting authority may also request evidence of proper performance. The bid must comply with the procurement documents and include the required price table with all unit price fields completed. The team must include a person with valid switching authorisations for work-related switching in the 0.22–20 kV network, who has been entered into Elektrilevi’s partner portal before the opening of bids; for low-voltage works, at least low-voltage switching authorisations are sufficient, while in other cases both low-voltage and medium-voltage switching authorisations are required. There must also be a person appointed as responsible for the work operation, entered into the Elektrilevi partner portal before the deadline for submitting bids. In addition, the team must include a lead electrical works person with valid A-competence or, within the meaning of the Vocational Education Act, at least level 6 qualification, with the relevant proof available at the time of bid submission and entry into the partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included. If the bidder does not join the contracting authority’s factoring programme, the standard payment term applies according to the contract value: 14, 35 or 45 calendar days. In the case of a joint bid, an authorised representative must be appointed and a joint bidders’ power of attorney must be attached. The bidder must also confirm compliance with the tender conditions and indicate any business secret or confirm that the bid contains no business secret.
