Compliance requirements

The bidder must be excluded if a mandatory exclusion ground applies to the bidder or to a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder: participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; enabling the employment of a foreign national staying in the country unlawfully or violating the conditions for employing a foreign national; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, or that has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works are not produced in or originating from Russia or Belarus; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, at least one of them with a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in public procurement cases, the reference numbers. Upon request by the contracting authority, evidence of proper performance of the similar electrical construction contracts must be provided, unless the authority can obtain the information from public or its own databases without significant cost. The tender must comply with the procurement documents and include a price table with all unit price fields completed. The bidder’s team must include a person with valid switching rights who is entered in Elektrilevi’s partner portal before the opening of tenders; for low-voltage works at least low-voltage switching rights are required, and in other cases both low-voltage and medium-voltage switching rights are required. There must also be a person designated as responsible for the work operation, entered in the partner portal before the tender submission deadline. In addition, the team must include a lead electrical worker with valid A-competence or at least level 6 qualification within the meaning of the Occupational Qualifications Act, with the relevant proof available at the time of tender submission; this person must also be entered in the partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included. The tender must state whether the bidder chooses the contracting authority’s standard payment term or the 95-calendar-day payment term under the factoring programme. If precise requirements or evidence are not sufficiently described in the machine-readable notice, they must be checked in the tender documents.
