Compliance requirements
The bidder must confirm that neither it nor its management or authorised representatives have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the tender documents. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures to restore reliability. In the machine-readable notice, the exclusion grounds were mainly set out in the ESPD; the exact list must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bid must comply with the technical specification (Annex 1 to the tender documents). To demonstrate compliance, the bidder must provide references and manufacturer documents or information materials for the offered product and complete the required form for compliance checking. A participation application (Form 1) must be submitted with the bid. If the bid is signed by a person without registration-based authority to represent the bidder, a power of attorney (Form 2) must be included. In a joint bid, the joint bidders’ power of attorney must be attached. The bid must be unconditional, and the bidder must confirm that it meets all conditions set out in the tender documents. The price offer must be submitted on Form 4. If equivalence is relied upon, it must be explained and supporting evidence must be attached. If exact technical or form requirements need to be checked, the tender documents must be consulted.
