Compliance requirements

The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering or financing of terrorism. A bidder is also excluded if it has been convicted of unlawful employment of foreign workers, breach of the conditions for employing foreigners, or unlawful use of child labour, or if it has tax, fee or environmental charge arrears, or social security contribution arrears under the law of its country of establishment. As a discretionary ground, the contracting authority may also exclude a bidder that has seriously or persistently breached a previous public contract or has submitted false information about qualification. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

During the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. The contracting authority may request evidence that the similar electrical construction contracts were properly performed. The bid must include the price table and the bidder must confirm that the bid complies with the procurement documents. The team must include a person with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the opening of tenders; if only low-voltage works are procured, at least low-voltage switching authorisations are sufficient, otherwise both low-voltage and medium-voltage switching authorisations are required. There must also be a person appointed as responsible for the work operation, entered into the Elektrilevi partner portal before the deadline for submitting tenders. The team must also include a lead electrical worker with valid A-competence and/or at least level 6 qualification under the Vocational Education Act, with the relevant certificate available at the time of submission. The bidder must provide the name, job title and contact details of the person signing the contract, and, if necessary, a power of attorney, as well as the contact person for contract performance matters. If the bidder is part of a joint tender, a joint bidders’ power of attorney must be attached. The bidder must also confirm the standard payment term and that the materials, equipment and goods used in the works do not originate from the Russian Federation or the Republic of Belarus.
