Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal employment of foreign workers or breach of foreign workers’ employment conditions, illegal use of child labour or human trafficking, and tax, fee or environmental charge arrears or social security contribution arrears in the bidder’s country of establishment. The bidder must also confirm that none of the voluntary exclusion grounds apply, such as a material breach of a previous public contract or the submission of false information about qualification. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus, and the materials, equipment and goods used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of which must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party (including the client representative’s contact details, phone number and email address) and, in the case of public procurement, reference numbers. Upon request by the contracting authority, evidence of proper performance must be provided. The bid must comply with the procurement documents and include the required price table with all unit price fields completed. The team must include a person with valid switching rights who has been entered into Elektrilevi’s partner portal before the bid submission deadline; for low-voltage works at least MV switching rights are required, and in other cases both MV and HV switching rights are required. There must also be a person appointed as responsible for the work operation, entered into the partner portal before the bid submission deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The team must also include a person responsible for electrical works with valid A-competence and/or a qualification corresponding to at least level 6 under the Vocational Education Act, who has the relevant certificate at the time of bid submission and is entered into the partner portal before the bid submission deadline. The bidder must indicate whether the bid contains trade secrets and justify such designation; the bid price and other numerical indicators corresponding to award criteria may not be marked as trade secrets. The bidder must also confirm that the standard payment term chosen is the contracting authority’s standard term, unless the bidder joins the factoring programme.
