Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, enabling the employment of a foreign national staying in the country illegally or violating the conditions for employing a foreign national, illegal use of child labour or human trafficking, and tax, environmental charge or social security contribution arrears. The bidder must also confirm that none of the optional exclusion grounds apply: a material or repeated breach of a previous public contract and the submission of false information or failure to provide requested documents. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party (including the client representative’s contact details) and, in the case of public procurement, reference numbers; the contracting authority may also request evidence of proper performance. The tender must comply with all conditions set out in the procurement documents, and conditional tenders are not allowed. The tender price must be submitted in the required table, and all unit price fields must be completed. The bidder’s team must include a switching-authorised employee who has been entered into Elektrilevi’s partner portal before the opening of tenders. For low-voltage works only (0.22–1 kV), at least low-voltage switching authorisation is required; in other cases, both low-voltage and medium-voltage switching authorisations are required. There must also be a person appointed as responsible for the work operation, and that person must be entered into Elektrilevi’s partner portal before the deadline for submitting tenders. The bidder must provide the names, job titles and contact details of the person(s) signing the contract, as well as the contact person for matters related to contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must confirm whether it chooses the contracting authority’s standard payment term or joins the factoring programme, in which case the payment term is 95 calendar days. The bidder’s team must include a lead electrical works specialist with valid A-competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, with the relevant proof available at the time of submitting the tender and entry into Elektrilevi’s partner portal before the deadline. The bidder must indicate whether the tender contains business secrets and justify that designation; the tender price and other numerical indicators corresponding to award criteria may not be marked as business secrets. The materials, equipment and goods used during the works, including components, must not be produced in or originate from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
