Compliance requirements

The bidder must confirm that neither it nor the members of its management bodies have been finally convicted within the last 5 years of offences such as fraud, participation in a criminal organisation, corruption, money laundering, terrorism-related offences, child labour, human trafficking, tax arrears or any other exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The compliance conditions also include a confirmation that subcontractors or suppliers linked to the Russian Federation will not be used for more than 10% of the contract value. Such a bid may be rejected by the contracting authority.

Qualification criteria and exclusion grounds

For the creative therapy lot, the service must be provided by a specialist who has completed a master's degree in creative therapy and has at least 2 years of work experience in the field. The service provider is preferably a member of the Estonian Association of Creative Therapies, and documents proving compliance with the requirements must be submitted with the bid. The bidder must be registered in the commercial register of its country of establishment, and the contracting authority may require proof of registration. If the bidder uses subcontractors, it must specify what share of the contract will be performed through subcontracting, and separate ESPDs may be required for those subcontractors. The bid must include the participation application, the list of services and, where applicable, a power of attorney if the bid is signed by someone other than the registered representative.
