Compliance requirements
The notice includes the standard exclusion grounds for criminal organisation participation, corruption and fraud. The bidder or its management, administrative or supervisory body members, or persons authorised to represent, decide for or control the bidder must not have a final conviction within the last five years, unless the exclusion period has expired. If an exclusion ground applies, the bidder may provide evidence of self-cleaning where allowed. The machine-readable notice did not include any more specific exclusion grounds; these must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed at least one contract for media monitoring services within the 36 months before the start of the procurement. The completed contract must have a value of at least EUR 20,000 excluding VAT. If the contract continued after the deadline for submitting tenders, only the part delivered to and accepted by the client by the start of the procurement counts for qualification. The bidder must provide the details of at least one such contract and, if it was awarded as a public procurement contract, refer to the procurement reference number. The compliance conditions also require the bidder to confirm that the tender complies with the procurement documents, that a joint bid includes a power of attorney from the joint bidders where applicable, that any trade secret is justified if claimed, and that the bidder has the rights, licences or direct agreements needed to monitor and deliver media content from the required channels. If requested by the contracting authority, supporting documents proving compliance must be submitted.
