Compliance requirements
The bidder and the persons in its management, representation or control are subject to the usual exclusion grounds: participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, use of child labour and other forms of trafficking in human beings, commission of a terrorist act or offences linked to terrorist activity, and any other exclusion grounds named in the ESPD and tender documents. If an exclusion ground applies, the bidder may in certain cases submit evidence of self-cleaning measures to restore reliability. The ESPD also requires confirmation that the bidder will not use subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value, in line with EU sanctions rules.
Qualification criteria and exclusion grounds
The bidder must prove financial and technical capacity. The net turnover for the last financial year ended by the start of the procurement must be at least EUR 3,660,000. Joint bidders may aggregate turnover. If the bidder relies on another entity’s resources, the bidder must also provide that entity’s details and, if requested, the consent and evidence required by the contracting authority.
For technical and professional capacity, the bidder must submit a list of contracts for public road construction works or maintenance works completed within the 60 months preceding the start of the procurement, together with evidence on request that the works were performed properly. The contracting authority may also take older contracts into account if needed to ensure sufficient competition.
The bid must comply with the tender documents. The bidder must submit the fully completed HD III cost schedule as an Excel file. If a bid guarantee is required, it must be EUR 20,000 and valid for at least 4 months from the deadline for submitting tenders. If the bid validity is extended, proof of extension or a new guarantee must be provided.
