Compliance requirements
The bidder must confirm that neither it nor its management, representative or supervisory body members have, within the last five years, been finally convicted of participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, or offences related to committing a terrorist act or terrorist activity. Fraud is also covered by the confirmation questions.
If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contracting authority may also ask for the date of conviction, the reason, the person convicted, the duration of exclusion and electronically available evidence.
As regards subcontractor checks, the bidder must confirm that it will not use a subcontractor in performance of the contract if that subcontractor would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must show annual turnover of at least EUR 300,000 in each of the last three financial years completed by the start of the procurement. The information must be provided in the ESPD.
For technical and professional capacity, the bidder must have properly performed at least one contract for the construction or reconstruction of a full-size artificial-turf football pitch within the last 60 months. The bidder must also have properly and in line with good construction practice completed one contract for the supply and installation of a similar outdoor stand with at least 150 seats within the last 60 months. For both references, the bidder must provide a short description, the performance period, the other contracting party’s details and, in the case of a public procurement, the reference number. On request, the contracting authority may require proof of proper performance.
To perform the contract, the bidder must involve a project manager and a road engineer. CVs must be submitted for both persons, and if they are not employed by the bidder, their confirmation that they will actually participate in performance must also be provided. The project manager must hold at least a construction manager qualification at level 6 or equivalent, have 5 years of experience in managing construction works, and have managed at least one stadium construction or reconstruction contract within the last 60 months. The road engineer must have level 6 or higher, not initial level, in the speciality of road construction and maintenance and in the occupation of management of construction activities, or equivalent.
The bid must comply with the tender documents, conditional bids are not allowed, and the bid price must be submitted according to the required structure. The bidder must also confirm compliance with the requirements and, where necessary, explain equivalence and attach proof. In the case of a joint bid, a power of attorney from the joint bidders must be included. The bidder must also confirm that it will not use a subcontractor in performance of the contract if that subcontractor would have to be replaced under Section 122(7) of the Public Procurement Act.
