Compliance requirements
The tender documents include mandatory exclusion grounds based on criminal convictions, including participation in a criminal organisation and corruption. The bidder or its management/representation persons must confirm whether any such final conviction exists within the last five years or whether an exclusion period still applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where allowed by law or by the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total annual turnover for each of the last 3 financial years completed by the date of commencement of the procurement procedure must be at least EUR 120,000. If the information is not available from public registers, the bidder must provide an extract from the annual accounts or another proof of turnover upon the contracting authority’s request.
Within the 36 months before publication of the contract notice, the bidder must have completed at least one design contract similar to the subject of this procurement. A similar design contract means a contract where the bidder acted as the main contractor, designed a building or building complex with at least 600 m2 of closed net floor area, and completed the work at least to main design stage, including a building permit or acceptance by the client. The contract must have included at least the architectural, structural, technical systems, electrical installation, fire safety and energy performance parts.
The bidder’s team must include a project manager with either a level 7 qualified civil engineer certificate or a level 7 authorised architect certificate, and with experience of managing at least one similar design contract as the main contractor’s project manager within the last 36 months. The team must also include an architect with a level 7 authorised architect qualification and experience as the main contractor’s architect in at least one building or building complex over 600 m2 within the last 36 months.
The project manager and the architect may not be the same person. If the professional qualification was issued in Estonia, the contracting authority checks it in the public qualification register; if it was issued abroad, the bidder must submit the qualification document and a confirmation from the competent Estonian authority that it is equivalent.
In the case of a joint bid, a power of attorney for the joint bidders must be submitted and the share and nature of each joint bidder’s part of the contract must be stated in the bid.
The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the tender documents or official tender details. The bidder must also submit the required forms and confirmations mentioned in the tender documents.
