Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Estonian Public Procurement Act apply. The bidder must also confirm that neither the bidder nor the persons entitled to represent, decide for, or control the bidder have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence, money laundering or terrorist financing, illegal employment of a foreign national staying without legal basis, enabling a foreign national to work in Estonia in breach of the rules, or illegal use of child labour or human trafficking. The bidder must confirm that no tax, duty or environmental charge debt exists, and that awarding the contract would not breach an international sanction or a sanction of the Government of Estonia. If the bid involves a foreign company, the bidder must submit documents proving the absence of exclusion grounds for that company and for its representatives, if the contracting authority cannot verify the information from public registers.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 3,000,000 excluding VAT, with at least EUR 1,000,000 in each year. If the bidder is not registered in Estonia or if the contracting authority cannot verify compliance from public data, extracts from annual reports or other evidence must be submitted on request. Joint bidders may rely on each other’s figures. To prove technical capability, the bidder must have properly performed at least one supply contract in the 36 months before the start of the procedure, where the subject was the sale and delivery of high-pressure gas pipes or equivalent high-pressure pipeline materials for at least EUR 300,000 excluding VAT per contract. The delivered products must have been accepted by the client, and compliance must have been ensured by the date of publication of the contract notice at the latest. If the bidder relies on another entity’s capacities or is a foreign company, the relevant confirmations and evidence must be provided. The bid must also include a bid security of EUR 15,000, a duly completed price schedule, and a confirmation letter showing that the bidder has the capacity to supply pipe meeting the requirements; if the bidder is not the pipe manufacturer, an agreement with the manufacturer must exist.
