Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, if insolvency or liquidation proceedings have been opened against it, if its business activity has been suspended, or if it is in a similar situation under the law of its country of establishment. The bidder is also excluded if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears, unless the debt has been deferred, paid, or will be paid/deferred within 10 calendar days after receiving the relevant notice.
The notice also requires confirmations that the bidder has no exclusion grounds under the specified provisions of the Public Procurement Act, that the average salary of its employees was not below 70% of the average salary in the relevant sector during the reference period, and that the bidder is not a related person to the technical consultant advising the apartment building reconstruction. If the required evidence cannot be checked in public registers, the bidder must submit supporting documents within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also be registered for electrical works covering the construction, including installation, of an electrical installation. Foreign bidders are exempt from the Estonian register entry requirement but must prove equivalent competence.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the expected contract value excluding VAT. The exact amount must be entered to the nearest euro.
The bidder must provide information on at least one equivalent construction contract completed within the 60 months before the start of the procurement procedure. An equivalent contract means the construction, extension or full reconstruction of a building as the main contractor, including at least the construction or reconstruction of the load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a heating system. Completion must be evidenced by a handover-acceptance certificate signed by the client and contractor or by the number of the occupancy notice or building permit in the building register.
For the complete reconstruction of an apartment building, the team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, where electrical works are performed, a person with the required electrical competence. Specific qualification levels are required for each role: level 6 civil engineer or level 6 construction manager for the project manager, level 5 construction foreman for the site manager, the relevant level 6 engineering or construction manager qualification for the ventilation and heating systems specialist, the relevant engineering or construction manager qualification for the water supply and sewerage systems specialist, and either a class B competence certificate or a level 6 electrical engineer qualification for electrical works. If the bidder relies on the capacities of other persons, signed confirmations of their participation in contract performance must be included.
