Compliance requirements
The tender documents set out mandatory and voluntary exclusion grounds. The bidder must confirm that none of the mandatory grounds apply, including convictions for organised crime, corruption, fraud, terrorist offences, money laundering or terrorism financing; illegal employment of foreigners or underpayment below the legal wage; child labour or human trafficking; tax, duty or social security arrears; and any situation where awarding the contract would breach an international or Government of the Republic sanction. The bidder must also confirm that no voluntary exclusion grounds apply, such as breaches of environmental, social or labour obligations, bankruptcy or liquidation, serious professional misconduct, anti-competitive conduct, conflicts of interest, prior serious contract breaches, false information, obstruction of the contracting authority, tax offences, or lack of the right to submit a tender.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 2,500,000. If the financial year does not coincide with the calendar year, this requirement applies to the last three completed financial years, and at least six months must have passed since the end of the most recently completed financial year by the tender submission date. As evidence, the bidder must provide an extract from the reports for the last three completed financial years showing the net turnover. The tender must also include Form 1 for the price, Form 2 for the technical information on the medium-voltage switchgear, Form 4 for the technical information on 6–35 kV network surge arresters, and Form 5 for the reserve equipment price table. In addition, the bidder must provide the details of the contract signatory and the contact person, and a power of attorney where necessary. The tender must comply with all conditions set out in the tender documents, and conditional tenders are not permitted.
