Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; no convictions for illegal employment of a foreigner or breach of conditions for employing a foreigner, including paying less than the statutory wage; no convictions for illegal use of child labour or human trafficking; no tax, fee or environmental charge arrears, or social security contribution arrears in the country of establishment; and no conflict with international sanctions or sanctions of the Government of the Republic of Estonia. Qualification criteria and exclusion grounds

The bidder must hold a business licence or other legal right to sell fuel under the laws of its country of establishment. If the bidder is not registered in Estonia or does not have a valid business licence for fuel sales in the Estonian Register of Economic Activities, it must provide evidence of the corresponding right under the laws of its country of establishment; a bidder’s confirmation together with an extract from the relevant legal act is also acceptable, if available. For Estonian bidders, the contracting authority checks the licence in the register itself. The bidder’s net turnover for the last three financial years ended by the start date of the procurement must in total be at least twice the estimated value of the lot or lots for which the bid is submitted. Joint bidders may combine their turnover figures. If the bidder relies on the resources of another undertaking, a jointly signed confirmation from both parties must be submitted stating that the resources are available, their use is permitted, the bidder will use them in contract performance, and both parties will be jointly and severally liable for the part of the contract performance based on those resources. The bid must be submitted in the required forms and structure; if the forms are completed incorrectly or only partially, the contracting authority may reject the bid. In the case of a joint bid, an authorised representative must be appointed and a joint power of attorney must be attached. The bidder must provide a list of filling stations showing the station address, type, opening hours, fuels sold, AdBlue if available, and additional services and accessories. There must be at least 30 stations in Northern Estonia, at least 21 in Southern Estonia, at least 5 in Northeastern Estonia, at least 9 in Western Estonia and at least 9 in Central Estonia.
