Compliance requirements
The bidder must confirm that neither the bidder nor its management, governing or supervisory body members, nor persons authorised to represent, decide for or control the bidder, have been finally convicted within the last five years for participation in a criminal organisation or corruption, or that any exclusion period in the judgment still applies. If an exclusion ground exists, the bidder may provide evidence of self-cleaning measures where allowed by law or the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 90,000. If the data are not publicly available to the contracting authority from official registers, the authority may request an extract from the last three annual accounts or another proof confirming the turnover.
The bidder must have performed at least one similar design contract within the 36 months preceding the publication of the contract notice. A similar design contract means a contract where the bidder acted as the main contractor, the design covered a building or building complex with at least 200 m2 of enclosed net floor area, and the work was completed at least at the main design stage with a building permit or accepted by the client. The contract must have included at least the architectural part, structural part, technical systems part, electrical installation part, fire safety part and energy performance part. The technical systems part must have covered, among other things, heating, ventilation, cooling, heat supply, water supply and sewerage; the electrical installation part must have covered power, weak current and automation. In addition, the design work must have been carried out as BIM model design.
The bid must comply with the tender documents, and conditional bids are not allowed. In the case of a joint bid, a power of attorney for the joint bidders must be submitted and each bidder’s share and the nature of that share must be stated. If equivalence is relied on, it must be explained and, where necessary, supported by evidence.
The machine-readable notice did not include more precise qualification or compliance requirements; these must be checked in the tender documents.
