Compliance requirements
The tender documents include mandatory exclusion grounds based on final convictions, including participation in a criminal organisation, corruption, fraud and other standard grounds under the Public Procurement Act. If any exclusion ground applies, the bidder may be asked to explain self-cleaning measures and provide evidence. The machine-readable notice did not include the full list in a concise form, so the exact exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must confirm that the tender complies with all requirements set out in the procurement documents and that the tender remains valid for 3 calendar months from the tender submission deadline. In the case of a joint tender, a power of attorney for the joint bidders must be submitted; if the tender is not joint, this must be confirmed separately. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. The bidder must also confirm that it does not involve subcontractors, suppliers or rely on the capacities of entities accounting for more than 10% of the contract value if those entities are Russian citizens, residents or entities established in the Russian Federation, or are more than 50% owned by such persons or entities, or act on their instructions. To prove technical compliance, the bidder must submit the completed technical specification, the manufacturer’s confirmation of compliance with ÖNORM F2105 or DIN 14811:2008-01, or proof of equivalence, and for couplings a certificate of compliance with ISO 9001 together with the accompanying documents. The bidder must also provide 1 sample of a 42 mm fire hose to the contracting authority’s location before the tender deadline. The warranty period must be at least 24 calendar months from the signing of the handover certificate. As to exclusion grounds, the bidder must confirm that neither the bidder nor its management body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and other grounds named in the tender documents; if needed, self-cleaning measures and evidence must be provided.
