Compliance requirements
The bidder must not have the exclusion grounds listed in § 95(1) points 1–5 and § 95(4) point 12 of the Public Procurement Act. The bidder must confirm in the procurement register that these circumstances do not apply. If the bidder has other persons in the company who are authorised to represent the company, make decisions on its behalf or control it, and who are not visible to the contracting authority from the commercial register card, the bidder must provide the authorised person’s name and personal identification code, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
Over the 60 months preceding the start of the procurement, the bidder must have properly completed at least 2 contracts for the construction or reconstruction of outdoor lighting systems. The contracts may have included a warranty, provided they were otherwise properly completed. To prove this, the bidder must submit the list of contracts on Appendix 3, the clients’ confirmations of proper performance, and for each contract a short description, the performance period and the contact details of the other contracting party. If the bidder relies on another company’s resources, Appendix 6 consent must be submitted and the subcontractor must be added to the bid where necessary. In a joint bid, Appendix 7 power of attorney must also be submitted. The bidder must provide a technical description of the luminaires, including the make, type, model designation, power, manufacturer’s name and a picture or photo. The bidder or its subcontractor must be registered in the economic activities register for electrical works, with the sub-activities of electrical installation design and electrical installation construction, or must have the legal right under the law of its country of establishment to perform those works.
