Compliance requirements

The tender documents state an exclusion ground based on the bidder’s country of origin. Bidders originating from third countries are excluded. In this notice, third countries mean countries that are not EU Member States, EEA Agreement countries, or WTO GPA countries, and countries with which the EU has not concluded a reciprocal free trade agreement covering public procurement. The bidder must confirm that it is not originating from a third country and, if requested, state its country of origin.

Qualification criteria and exclusion grounds

The bidder’s average annual sales revenue over the last 3 financial years must be at least EUR 5,000,000. If the bidder is not an Estonian company, it must be ready to provide signed copies of its annual financial statements or other equivalent evidence. Within the last 60 months before the start of the procurement, the bidder must have at least one reference: it must have supplied a flue gas condenser for a biomass CHP boiler with a capacity of at least 20 MWth. The reference must include the customer’s name and contact details, the type and capacity of the flue gas condenser, and the date of acceptance of the works to the nearest month and year. To demonstrate compliance, the bidder must submit the technical requirements form, technical specifications and, if necessary, drawings. If the bidder is the manufacturer’s representative in Estonia, a manufacturer’s confirmation of the right of representation must be included. The warranty period must be at least 24 months from acceptance of the works. The bidder must also confirm acceptance of the payment schedule, the technical response-time terms and the contractual penalty terms.
