Compliance requirements
The tender documents state one exclusion ground: the contracting authority excludes tenderers originating from third countries. In practice, the bidder must confirm that it is not from a third country. A third country means a country that is not an EU member state, an EEA country, a WTO GPA country, or a country with a reciprocal free trade agreement with the EU covering public procurement. If the bidder is from such a country, it may be excluded. The notice also asks for the bidder’s country of origin; the exact way to provide it must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must show an average annual turnover of at least EUR 6,200,000 over the last 3 financial years. If the bidder is not an Estonian company, it must be ready to provide a signed copy of its financial statements or other equivalent evidence. The bidder must also have, within the last 60 months before the start of the procurement, at least one reference: a flue gas condenser for a biomass CHP boiler with a capacity of at least 35 MWth. For the reference, the bidder must provide the client’s name and contact details, the type and capacity of the flue gas condenser, and the date of acceptance of the works, stated by month and year. As for compliance requirements, the bidder must submit a joint tender power of attorney if the bid is joint, confirm that the offer complies with the tender documents, provide the price offer in the required structure, explain equivalence and attach evidence where needed, provide a trade secret marking or confirm that there is none, submit the technical requirements form, the technical specification, accept a warranty period of at least 24 months, accept the payment schedule, accept the response time and onsite support terms, provide a declaration from the manufacturer or the authorised representative in Estonia, and accept the contractual penalty terms. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
