The bidder must confirm the mandatory exclusion grounds in the tender documents, especially criminal organisation participation, corruption, fraud and other conviction-based grounds. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. Qualification criteria and exclusion grounds
The machine-readable notice did not include precise selection, suitability or compliance requirements; these must be checked in the tender documents. The ESPD does, however, require the bidder to confirm its status and answer the exclusion-ground questions. The compliance terms state that the offer must include a buy-back margin that may not exceed three times the offered sales margin. The bidder must also confirm that the offer complies with the tender documents, that a power of attorney is attached in the case of a joint tender, that any trade secret is justified, that equivalence has been explained, and that the goods offered are not subject to international sanctions. In addition, the bidder must confirm that it has reviewed the consumption data of Tallinn University, Dormitorium NGO and the Tallinn University Academic Library, and that during the supply period it has the status of a balance responsible party or a valid contract with a balance responsible party for open supply and balance management. If proof is required, a copy of the balance agreement or other required evidence must be submitted.
