Compliance requirements
The tender documents include mandatory exclusion grounds. A bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor persons authorised to represent, decide for or control the bidder, have been finally convicted in the last five years for criminal organisation participation, corruption, fraud, terrorist offences or other listed grounds. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The exact list and any detailed confirmations must be checked in the tender documents.
Qualification criteria and exclusion grounds
To make the bid compliant, the bidder must provide several confirmations and attachments. The bidder must confirm that, in the case of a joint bid, a written power of attorney is submitted; that the bid does or does not contain trade secrets, with a justification if it does; that the bidder meets the condition set out in point 4.4 of the tender documents; that the offered goods are not subject to international sanctions and do not originate from sanctioned areas; and that the bidder sells motor fuel under the conditions set out in the tender documents. In addition, the bidder must submit the detailed price form from Annex 3, Form 1, a list of all fuel stations located in Estonia with addresses, opening hours, fuels sold and services provided, and the discounts offered for fuel-station goods and services. A foreign bidder must also submit a document proving the right to sell motor fuel in Estonia, such as an operating licence. The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents.
