Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including criminal organisation participation, corruption and the other standard exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may have to provide details of the conviction, the date, the reason, who was convicted, the exclusion period and any self-cleaning measures. The machine-readable notice did not include the full precise list, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment; for an Estonian bidder the contracting authority checks this itself, while a foreign bidder must provide proof of registration if requested. The bidder must hold a valid wholesale distribution authorisation for medicines, and for medicines without a marketing authorisation it must have an import permit issued by the Medicines Agency by the contract start date at the latest. The bid must include the completed detailed price offer form for all lots for which the bidder submits an offer, and the maximum price for each lot must match the amount entered in the procurement system. If subcontractors are used, their details and share of performance must also be provided. The contracting authority may request the summary of product characteristics or package leaflet for the offered medicine in Estonian or English. The bidder must confirm that the bid complies with all tender document requirements, that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that subcontractors or suppliers linked to Russia do not exceed 10% of the contract value.
