Compliance requirements

The machine-readable notice states that the bidder must confirm the absence of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business has not been suspended. In addition, the bidder must confirm that it has no tax, fee, environmental charge, social security contribution or similar debt under the law of its country of establishment, and that its average employee salary during the reference period was above 70% of the average salary in the relevant field. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. These Estonian register requirements do not apply to a foreign bidder, but the foreign bidder must provide an equivalent proof of competence where relevant. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, it is sufficient if at least one joint bidder meets this requirement on its own. Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the construction, extension or full-building reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing structure and external envelope, the construction or reconstruction of a heat-recovery forced ventilation system, and the construction or reconstruction of a heating system. Completion must be proven either by a handover-acceptance certificate signed by the client and contractor or by the relevant completion data in the building register, such as a notice of use or a use permit number. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, when electrical works are carried out, a person with the required electrical competence. The name and professional certificate number must be provided for each role. The project manager must have at least a level 6 construction engineer qualification with a specialisation in building construction or a level 6 construction manager qualification with a specialisation in general construction. The site manager must have at least a level 5 construction work supervisor qualification with a specialisation in general construction works. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification with the relevant competences, or a level 6 construction manager qualification with a specialisation in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification, or a level 6 construction manager qualification with the relevant specialisation. For electrical works, the person must have at least a B-class competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. The bidder must be ready to provide a performance guarantee equal to 5% of the contract value at contract signing or within 10 calendar days after signing. The guarantee may be provided by a bank or financial institution, or by depositing the money to the beneficiary’s or a notary’s account, provided that the beneficiary remains the entitled party throughout the construction period. Joint bidders may provide the guarantee together together.
