Compliance requirements
The successful bidder will be checked for exclusion grounds. The bidder must confirm that neither the bidder nor a joint bidder has the exclusion grounds referred to in Section 95(1)(1)–(3) and (5) of the Public Procurement Act, taking into account Section 95(2). The bidder must also confirm that neither the bidder nor a joint bidder is bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against them, and that their business has not been suspended or they are not in a similar situation under the law of their country of establishment. The bidder must confirm that it has no unpaid state taxes, fees or environmental charges, or tax or social security contribution arrears under the law of its country of establishment. The bidder must confirm that its employees’ average salary during the reference period was more than 70% of the average salary for the same period in the relevant field. This must be proven with a Tax and Customs Board extract. The bidder must also confirm that it is not a related person to the technical consultant advising the support recipient on the reconstruction of the apartment building.
Qualification criteria and exclusion grounds
The bidder must have filed in the business register a notice under the construction activity area covering general construction, indoor climate systems, and water supply or sewerage systems within the building or connected to it. For electrical works, the bidder must have a notice in the business register for electrical works, including construction and installation of electrical installations. For a foreign bidder, an equivalent proof may be submitted instead of a register entry.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be stated to the nearest 1 euro.
The bidder must confirm that it can provide, by the contract signing date at the latest or within 10 calendar days after signing, a performance security confirmed by a credit or financial institution in the amount of 5% of the contract value. The security must remain valid throughout the construction period; alternatively, the same amount may be deposited into the support recipient’s or a notary’s account, provided that the support recipient remains the beneficiary throughout the construction period.
The bidder must prove that within the 60 months before the start of the procurement procedure it has carried out at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means the construction, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the building’s load-bearing structures and external envelope, the construction or reconstruction of a heat-recovery ventilation system, and the construction or reconstruction of a heating system. The bidder must provide the project name, building details, time of performance and value, plus evidence by reference to the building register notice or building permit number, or by attaching a copy of the handover-acceptance report.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works. The project manager must hold at least a level 6 construction engineer qualification with a specialisation in building construction or a level 6 construction manager qualification with a specialisation in general construction. The site manager must hold at least a level 5 construction work manager qualification with a specialisation in general construction works. The ventilation and heating systems specialist must hold at least a level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or a level 6 construction manager qualification with a specialisation in indoor climate systems. The water supply and sewerage systems specialist must hold at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with a specialisation in the construction of internal or adjacent water supply and sewerage systems. For electrical works, the involved person must hold at least a category B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. For a foreign bidder, equivalent competence is sufficient. The name and qualification or competence certificate number of each person must be provided, and they must be involved in the performance of the works.
The bidder must have a quality management system in the field of construction works that complies with at least EVS-EN ISO 9001 and an environmental management system that complies with at least EVS-EN ISO 14001, or equivalent conditions in equivalent documents. The notice did not provide more precise requirements for any additional compliance items; these must be checked in the official tender documents or tender documents if needed. The bidder must also submit the joint bidders’ power of attorney if the bid is a joint bid, a trade secret explanation if applicable, a confirmation that the bid complies with the tender documents, an equivalence explanation and supporting evidence where relevant, the bid form, proof of representation rights, and confirmations from any non-employee team members if such persons are used in the bid.
