Compliance requirements
The successful bidder will be checked for exclusion grounds. The machine-readable notice did not include more precise exclusion details, so they must be checked in the tender documents. The bidder must confirm that neither it nor a joint bidder has the exclusion grounds listed in the notice, that neither is bankrupt or being liquidated, that no bankruptcy or liquidation proceedings have been opened and business has not been suspended, that there are no tax, fee, environmental charge, social security or similar debts under the law of the bidder’s country of establishment, and that the bidder is not a related person to the technical consultant advising on the apartment building reconstruction. The bidder must also confirm that its average wage during the reference period was more than 70% of the average wage in the same period in the relevant field, and provide a Tax and Customs Board extract as proof.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register under the activity area “Construction” with activity types covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration under the activity area “Electrical works” for the construction, including installation, of an electrical installation; for a foreign bidder, an equivalent proof is sufficient.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the expected contract value excluding VAT. In addition, the bidder must be able to provide a performance security amounting to 5% of the contract value by the contract date or within 10 calendar days after contract signature; the security must remain valid throughout the construction period and may be replaced by depositing the amount to the beneficiary’s or a notary’s account, provided the beneficiary remains the entitled party for the entire period.
Within the last 60 months, the bidder must have completed at least one equivalent construction work with a value of at least half of the expected contract value. An equivalent work means the construction, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a heating system. For this reference, the bidder must provide the project name, building details, execution period and value, as well as proof by reference to the building register occupancy notice or occupancy permit number, or a copy of the handover-acceptance certificate.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works. The project manager must hold at least level 6 professional qualification as a building engineer with a specialisation in building construction or level 6 qualification as a construction manager with a specialisation in general construction. The site manager must hold at least level 5 qualification as a construction work supervisor with a specialisation in general construction works. The ventilation and heating systems specialist must hold at least level 6 qualification as a heating, ventilation and cooling engineer with the relevant management competences, or level 6 qualification as a construction manager specialising in indoor climate systems. The water supply and sewerage systems specialist must hold at least level 6 qualification as a water supply and sewerage engineer with the relevant management competence, or level 6 qualification as a construction manager specialising in internal or associated water supply and sewerage systems. For electrical works, the involved person must hold at least a category B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. The name and qualification or competence certificate number of each of these persons must be provided, and they must be involved in the performance of the works.
The bidder must have a quality management system in the field of construction works that complies with at least EVS-EN ISO 9001, and an environmental management system that complies with at least EVS-EN ISO 14001, or equivalent conditions are acceptable.
For a joint bid, a power of attorney must be submitted naming the authorised representative and specifying each joint bidder’s share and role. The bid must be submitted by the bidder’s legal or authorised representative. If team members used to demonstrate capability are not employees of the bidder or are not listed in a public register as competent persons, written consent from each such person must be submitted. The bidder must also confirm that the bid is unconditional, that it fully accepts the tender document conditions, and that any equivalence relied upon is explained and supported by evidence. A bid form showing the total price by the cost lines set by the beneficiary must be submitted.
