Compliance requirements

The successful bidder will be checked for exclusion grounds. The bidder must confirm that neither it nor a joint bidder has the exclusion grounds listed in § 95(1) points 1–3 and 5, taking into account § 95(2). The bidder must also confirm that neither it nor a joint bidder is bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, social security or similar debt under the law of its country of establishment. The bidder must confirm that its average wage during the reference period was more than 70% of the average wage for the same period in the relevant field, and this must be proved with an extract from the Tax and Customs Board. The bidder must also confirm that it is not a related party to the technical consultant advising the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must have filed in the Register of Economic Activities a notice under the activity area of construction covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration under the activity area of electrical works for the construction, including installation, of an electrical installation; for a foreign bidder, an equivalent proof may be accepted. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be stated to the nearest 1 euro. Within the last 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value. An equivalent project means the erection, extension or full reconstruction of a building and must include at least the construction or reconstruction of load-bearing and external envelope structures, heat-recovery ventilation, and heating systems. The bidder must provide the building name, time of performance, value, information on the type of work, and proof by a handover certificate, occupancy notice, occupancy permit or equivalent record. The team must include a project manager with at least level 6 professional qualification as a construction engineer specialising in building construction and with construction management competence, or a level 6 construction manager qualification specialising in general building works. An on-site manager with at least level 5 construction foreman qualification specialising in general building works is also required. In addition, the team must include a ventilation and heating systems specialist with at least level 6 qualification as a heating, ventilation and cooling engineer with the relevant management competences, or a level 6 construction manager qualification specialising in indoor climate systems, and a water supply and sewerage systems specialist with at least level 6 qualification as a water supply and sewerage engineer or a level 6 construction manager qualification with the relevant specialisation. For electrical works, the team must include a person with at least a Class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. The name and certificate or competence number of each such person must be provided, and an equivalent qualification may be used for a foreign bidder. The bidder must have a quality management system in the field of construction works that meets at least EVS-EN ISO 9001, and an environmental management system that meets at least EVS-EN ISO 14001, or equivalent requirements in equivalent documents.
