Compliance requirements
The bidder is excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or otherwise suspended in a similar situation under the law of its country of establishment. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, unless the debt has been deferred or paid, or will be paid or deferred within 10 calendar days after receiving the notice.
The notice also requires confirmations that the bidder has no exclusion grounds under the Public Procurement Act sections referred to in the document, that the average wage of the bidder’s employees is not below 70% of the comparable sector average during the reference period, and that the bidder is not a related person to the technical consultant advising the contracting authority on the apartment building reconstruction. If the bidder cannot prove the absence of exclusion grounds from public registers, it must submit the requested evidence within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the financial year preceding the tender submission must be at least equal to twice the estimated contract value, with the estimated contract value always calculated excluding VAT.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means the construction, extension or full-building reconstruction of buildings as the main contractor, including at least the construction or reconstruction of load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a new heating system.
The bidder’s team must include: a project manager with at least a level 6 construction engineer qualification or a level 6 construction manager qualification; a site manager with at least a level 5 construction foreman qualification; a ventilation and heating systems specialist with at least a level 6 heating, ventilation and cooling engineer qualification or a level 6 construction manager qualification; a water supply and sewerage systems specialist with at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification; and, for electrical works, a person with at least a class B competence certificate or a level 6 electrical engineer qualification.
The bidder must have the relevant registration in the business register for construction activities covering general construction, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must have a registration for electrical works covering the construction, including installation, of electrical installations. This registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided instead.
The bidder must have a quality management system in the construction field that complies at least with EVS-EN ISO 9001 and an environmental management system that complies at least with EVS-EN ISO 14001, or equivalent conditions. If compliance cannot be checked from public registers, the relevant evidence and documents must be submitted. The bidder must also be able to provide a performance guarantee equal to 5% of the construction contract value, and any other evidence required by the tender documents, such as proof of previous work, qualifications or standards, must be submitted where applicable.
