Compliance requirements

The machine-readable notice states that the bidder must confirm there are no exclusion grounds under the Public Procurement Act section 95(1) points 1–5. These cover convictions for organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or breach of foreign workers’ conditions, including paying less than the statutory wage; child labour or human trafficking; tax, environmental charge or social security arrears; and situations where the contract would breach an international or government sanction. The notice also mentions a possible national restriction based on the bidder’s place of establishment or residence, if such a restriction is set in the procurement documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or another similar register of its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority will check the data itself. A foreign bidder must confirm registration in the required register if the laws of its country of establishment require it. To prove the origin of the goods and the ability to supply them, the bidder must submit a copy of the manufacturer’s original power of attorney or a notarised copy, if the bidder is not the manufacturer of the offered goods.
