Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not include precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the completed application for participation in the procurement, the completed price form and the technical description/offer form. The bidder must be the official representative and/or authorised reseller of the offered product and must provide a manufacturer’s document, or a copy of it, proving sales rights and technical support. The bidder must confirm that the products will be transported and stored in accordance with the manufacturer’s transport and storage conditions. The bid must comply with the requirements set out in the tender documents, and where necessary an explanation of equivalence and evidence of equivalence must be attached. The offered reagents and accessories must bear CE marking and comply with Regulation (EU) 2017/746, or be placed on the market under its transitional provisions; if the bid is submitted for products that still comply with Directive 98/79/EC, the manufacturer’s commitment must be included that the products will be replaced by products compliant with Regulation (EU) 2017/746 by the end of the transition period. Manufacturer technical data sheets, including certificates, safety data sheets, user manuals and storage/handling conditions, must also be submitted. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents.
