Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurists or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds and answers must be checked in the ESPD and the tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice mainly contains formal compliance confirmations: in a joint bid, a power of attorney for the joint bidders must be attached; conditional bids are not allowed; the bidder must confirm that the bid complies with the tender documents; and the price must be submitted according to the prescribed pricing form. The bidder must also confirm that, where relevant, equivalence has been explained and supporting evidence has been attached. No precise financial, experience, team or other substantive qualification requirements were included in the machine-readable notice; these must be checked in the ESPD and the tender documents.
