Compliance requirements
The bidder must confirm that neither the bidder nor its management, governing or supervisory body members, nor persons authorised to represent, decide for or control the bidder, have been finally convicted within the last five years for the listed exclusion grounds. The notice includes criminal organisation participation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour and other forms of trafficking in human beings, and other mandatory exclusion grounds from the tender passport. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The exact exclusion grounds and any proof requirements must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if required by the laws of that country. If the register data are not readily available to the contracting authority from public databases, an extract from the commercial register or other suitable evidence must be provided. As a financial and economic capacity requirement, the bidder’s average net turnover in the server sector over the last 3 completed financial years must be at least EUR 200,000 per year. For tender compliance, the bidder must confirm that the tender complies with the procurement documents, that any equivalence has been explained and supporting evidence has been attached, and that the tender has been submitted in the required structure. The bidder must also provide the manufacturer’s confirmation that it is an official partner and is authorised to sell the offered GPU server in Estonia. The machine-readable notice did not include precise other qualification or compliance requirements; these must be checked in the tender documents.
