Compliance requirements

The bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent, decide for or control the bidder, must not have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the tender documents, where applicable. If an exclusion ground exists, the bidder may provide evidence of self-cleaning measures where permitted. The tender documents also require that subcontractors and suppliers engaged in contract performance must be established in Estonia, another EU Member State, another EEA contracting state, or a country that has joined the WTO Government Procurement Agreement. The bidder must also confirm, where relevant, the details of authorised persons who are not visible in the business register.

Qualification criteria and exclusion grounds

The bidder must have completed at least 1 catering services contract within the 36 months before the start of the procurement, with a duration of at least 12 months, where the subject was providing school lunches at a school for at least 200 pupils or school staff. Only the part of the contract actually performed during the reference period counts. If the contract continued after the tender submission deadline, only the part and value delivered and accepted by that date may be used as proof. The bidder must submit, in the ESPD form, a list of completed contracts with the contract partner’s name and contact details, a description of the contract subject including the number of people catered for, the contract signing and performance dates, the contract period, and, for public contracts, the reference number. The contracting authority may contact the other contract party for verification. In addition, the bidder must confirm that the tender complies with the tender documents, that no conditional tender is submitted, that a joint tender includes the joint bidders’ power of attorney, that the site has been visited, and that the tender price is entered in the required structure. During contract performance, at least 20% of the total raw materials used each month for school meal preparation must come from organic production, covering at least once a month different product groups, including meat, eggs, dairy products, cereal products, and fruit and vegetables, including legumes. The bidder must also submit a 4-week sample menu.
