Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, terrorist offences, and related offences. The bidder must also confirm the sanctions-related statement in the tender documents. If an exclusion ground applies, the bidder may be able to show self-cleaning measures where allowed by law or the tender documents. The machine-readable notice did not include the full list in a concise form, so the exact exclusion grounds must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder's net turnover for the last financial year ended by the start of the procurement must be at least EUR 180,000. Joint bidders may aggregate turnover. As evidence, the contracting authority may request an extract from the latest annual report or other documents proving the turnover.
To prove technical and professional ability, the bidder must submit a list of road construction contracts for publicly used roads completed within the 60 months preceding the start of the procurement. The contracting authority may request confirmation from the client that the works were carried out properly. The exact scope of the experience requirement and any additional evidence must be checked in the tender documents.
For tender compliance, the bidder must complete all price fields in the HD IV bill of quantities in euros to two decimal places, must not change the rows or descriptions provided by the contracting authority, and must submit the fully completed Excel file. The bidder must confirm acceptance of all terms in the contract notice and procurement documents, submit a tender only for the matters requested by the contracting authority, not involve a subcontractor that would be subject to replacement under Section 122(7) of the Public Procurement Act, and indicate whether the tender contains trade secrets. In the case of a joint tender, a power of attorney and separate ESPD for each joint bidder are required. For authorised persons, the bidder must provide the name and personal identification code, or confirm that no such persons exist. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
