Compliance requirements

The exclusion grounds include, among others, participation in a criminal organisation, corruption, fraud and other statutory grounds listed in the ESPD. If such a ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The ESPD requires yes/no answers on these grounds and, where needed, explanations and evidence. In addition, companies with their place of residence or establishment in the Russian Federation or the Republic of Belarus are not allowed to participate.

Qualification criteria and exclusion grounds

The bidder must show a net turnover of at least EUR 150,000 in each of the last two completed financial years. If the financial year matches the calendar year, this means 2024 and 2025. The bidder must provide these turnovers in the ESPD. The bidder must have completed at least 1 similar design contract within the 36 months before the publication date of the contract notice. A similar contract means a contract where the bidder acted as main contractor and designed a building, part of a building, or a building complex with at least 500 m2 of enclosed net floor area, and the work was carried out at least at preliminary design stage. This must include the architectural part, structural part, technical systems part, electrical installation part, fire safety part and energy performance part. The bidder must provide contract details in the ESPD, including the partner names, contact details, object, size and contract period; if the contract was awarded through a public procurement procedure, the reference number must also be given. The bidder must involve a project manager with at least the qualification certificate “Diplomeeritud ehitusinsener, tase 7” with the specialization “Hoonete ehitus” and competence in “Projekteerimise juhtimine” or “Hoone ehitusprojekti koostamine”, or an equivalent qualification. For direct design work, specialists must be involved in the high-voltage, heating-ventilation-cooling and automation fields. The high-voltage specialist must have at least a valid B-level competence certificate with design rights, or the qualification certificate “Diplomeeritud elektriinsener, tase 7” with the relevant specialization and design competence. The heating, ventilation and cooling specialist must have at least the qualification certificate “Diplomeeritud kütte-, ventilatsiooni- ja jahutuseinsener, tase 7” with the additional competence “sisekliima tagamise süsteemi projekteerimine”, or equivalent. The automation specialist must have at least the qualification certificate “Diplomeeritud automaatikainsener, tase 7” with the specialization in building automation and design competence, or the qualification certificate “Diplomeeritud elektriinsener, tase 7” with the specialization in electrical automation or building electrical installations and design competence. Basic qualifications based only on education are not considered equivalent. Estonian qualification certificates are checked in the public qualification register; for foreign qualifications, a recognition document from the competent Estonian authority must be submitted. The bidder must submit a work plan and complete the required forms 2, 3, 4, 5 and, if applicable, 8. If the bid is joint, one representative must be authorised and a power of attorney plus a joint liability confirmation must be submitted. The bid must comply with all tender documents, and any equivalence must be clearly explained and evidenced.
