Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply, including convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal employment of foreign nationals, or child labour and human trafficking. The bidder must also confirm that it has no tax, social security or environmental tax arrears that would exclude it, and that the contract would not breach international or government sanctions. The notice also lists optional exclusion grounds such as breaches of environmental, social or labour obligations, bankruptcy or liquidation, serious professional misconduct, collusion, conflicts of interest, prior serious contract breaches, false information, attempts to influence the contracting authority, tax offences, or lack of the right to submit a tender. For subcontractors and suppliers, the bidder must confirm that it will not involve, for more than 10% of the contract value, Russian persons or entities covered by the sanctions restriction. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
