Compliance requirements
The bidder must confirm the standard exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, fraud, and other mandatory exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning where allowed. The machine-readable notice did not include the full precise list, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder’s average annual turnover for the audited financial year period ending before the start of the last three procurement procedures must be at least EUR 300,000 for the period 01/01/2023–31/12/2025. For construction works, the bidder must have performed, as the main contractor, at least 3 contracts for building or repairing public roads within the previous 60 months, and each contract must have included surfacing at least 30,000 m2 of road surface. The works must have been accepted by the client. The bidder must provide in the ESPD a list of the main completed contracts, including the client’s contact details, contract period, surfaced area and, where applicable, reference numbers. The bidder must involve responsible persons for the works, including a project manager whose professional qualification must meet the requirements set out in the tender documents; the exact qualification requirement was partially truncated in the machine-readable text, so it must be checked in the ESPD and tender documents. The bid must be submitted in the structure required by the tender documents and the standard pricing table must be attached. The bidder must confirm that the bid complies with the procurement documents and that no subcontractor is used who would have to be replaced under Section 122(7) of the Public Procurement Act. The bidder must also have a notice in the economic activities register for construction, road subcategory. The machine-readable notice did not include all precise qualification details, so the official tender documents must be checked for any missing requirements. The bidder must also confirm the required forms and declarations where applicable.
