Compliance requirements
The machine-readable notice set out the exclusion grounds in the usual form of criminal convictions and other statutory grounds. The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurists or other persons with authority to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or other similar exclusion grounds, where these are provided for in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification, suitability or compliance requirements beyond the tender passport and tender documents; these must be checked in the official tender documents. The offer must include the completed form "Appendix 3. Specification and price form for the offered goods" for the lots submitted. In the relevant lots, all blue-marked fields must be completed, including the medicine name, manufacturer and unit price without VAT. The offered goods must comply with the requirements set out in "Appendix 1. Technical specification". If a contract is signed by an authorised representative, a power of attorney from the bidder's legal representative must be included. For joint tenders, a joint bidders' power of attorney must be attached. The bidder must also confirm that the tender complies with the tender documents and, where relevant, that equivalence has been explained and supporting evidence has been attached.
