Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account Section 95(2). The bidder must not be bankrupt or in liquidation, must not be subject to bankruptcy or liquidation proceedings, and its business must not be suspended or in a similar situation. The bidder must not have tax, fee, environmental charge or social security contribution arrears under the law of its country of establishment. The bidder’s employees’ average wage during the reference period must be above 70% of the average wage for the same period in the relevant field for the contract subject; this must be proven by a Tax and Customs Board extract or, for a foreign bidder, by an equivalent authority’s certificate. The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. In a joint bid, exclusion grounds are checked separately for each joint bidder.

Qualification criteria and exclusion grounds

The bidder must be registered under the construction activity category with the activity types of general construction, indoor climate systems, and internal or associated water supply or sewerage systems; this registration requirement does not apply to a foreign bidder, but equivalent competence must be demonstrated where relevant. For electrical works, the bidder must have a registration under the electrical works activity for construction, including installation, of electrical installations; a foreign bidder may demonstrate equivalent competence instead. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. By submitting a bid, the bidder must accept that by the contract date, or at the latest within 10 calendar days after contract signature, it must be able to provide a performance-period security equal to 5% of the contract value, including a bank or financial institution guarantee or an equivalent deposit. Within the last 60 months, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT; the equivalent project must involve the erection, extension or full reconstruction of a building as the main contractor and must include at least load-bearing and external envelope works, mechanical ventilation with heat recovery, and a new heating system. For the equivalent project, the bidder must provide the project name, timing, value, details of the work content, and proof in the form of a use notice, occupancy permit or handover-acceptance certificate. The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction or level 6 construction manager qualification specialising in general construction; a site manager with at least level 5 construction foreman qualification specialising in general construction works; a ventilation and heating systems specialist with the relevant level 6 qualification or a level 6 construction manager qualification specialising in indoor climate systems; a water supply and sewerage systems specialist with the relevant level 6 qualification or a level 6 construction manager qualification specialising in internal or associated water supply and sewerage systems; a person performing electrical works with at least a class B competence certificate or level 6 electrical engineer qualification; and a chartered architect at level 7 responsible for compliance with the European New Bauhaus requirements. If team members are not the bidder’s employees, their written consent to participate must be provided. In addition, proof of a quality management system and an environmental management system in the construction field must be provided if this requirement is specified in the tender documents.
