Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including participation in a criminal organisation, corruption, fraud, money laundering, terrorist offences, child labour and human trafficking, as well as other criminal conviction grounds listed in the tender documents. If an exclusion ground exists, the bidder may need to provide evidence of self-cleaning where allowed. The machine-readable notice did not include the full precise list, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder must submit the ESPD and complete the forms required in the tender documents, including a power of attorney for joint bidding if the bid is submitted jointly, and the application for participation. The offered products must comply with the tender documents; where necessary, equivalence must be explained and evidence of equivalence must be attached. The offered products must bear the CE marking and be placed on the market in accordance with Regulation (EU) 2017/745 or its transitional provisions. Copies of the applicable conformity certificates or declarations of conformity must be submitted, with the products offered in this tender clearly highlighted where the documents cover multiple products. The bidder must have distribution rights for the offered products in Estonia and must provide a document, or a copy of it, proving such rights from the manufacturer or an authorised representative. The bidder must also have an e-shop or electronic ordering environment where the product price and stock level are visible during contract performance, and the website address must be stated in the bid. The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the official tender documents.
