Compliance requirements
The bidder must confirm that neither it nor members of its management or supervisory bodies have been finally convicted during the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, use of child labour or other forms of human trafficking, commission of a terrorist act, or offences related to terrorist activity. The same applies to any other exclusion grounds mentioned in the tender documents.
If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The tender documents also require a confirmation that the bidder will not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Estonian Public Procurement Act.
The machine-readable notice did not include all precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, and the contracting authority may require proof of registration.
For the construction works, the bidder must have at least one responsible person who will also act as the site manager if the contract is awarded. The site manager must have acted as site manager in at least one construction contract for a light traffic road. The site manager must hold a valid professional qualification of "Road Engineer, level 6" with specialisation in road construction and maintenance and the selected competence of managing construction activities, or an equivalent qualification at EQF level 6.
For the works and checks relating to the different disciplines, the contractor must involve specialists in the relevant field with professional education and work experience. The site manager must be present at the construction site every day throughout the performance period and regularly attend construction meetings in Elva. The contractor's representatives must also attend the meetings.
If the qualification was obtained outside Estonia, an Estonian translation of the relevant proof and a document confirming equivalence to EQF level 6 must be submitted. The bidder must provide the site manager's name, qualification, certificate number, date of issue and issuing body.
