Compliance requirements
The tender documents include the standard exclusion grounds from the Estonian Public Procurement Act, especially criminal convictions such as participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, and terrorist offences. The bidder or its managers, legal representatives or controlling persons must confirm whether any such ground applies. If an exclusion ground exists, the bidder may be allowed to provide evidence of self-cleaning where the procurement rules and tender documents permit it.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or an equivalent register in its country of establishment, and the contracting authority may require proof of registration. For construction experience, the bidder must have completed at least 2 construction contracts in the last 60 months, under which soil asphalt paving works were carried out on an area of at least 500 m2. For these contracts, the bidder must provide details including a short description of the work, the performance period, the client’s name and contact details, and the public procurement reference number if available. On request, the bidder must provide evidence that the works were performed properly. For the execution of the works, the bidder must involve a designer with experience in designing at least two similar projects with an area of at least 500 m2 and a valid civil engineer level 6 or equivalent professional certificate. The site manager or project manager must have participated as site manager in the construction of at least two similar projects with a built area of at least 300 m2, and must hold construction manager level 5 or an equivalent professional qualification. The tender must comply with the tender documents’ compliance requirements, include Annex 3 pricing form, and conditional tenders are not allowed. If an equivalent solution is offered, it must be explained and evidence of equivalence must be attached.
