Compliance requirements
The tenderer must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; no convictions for illegal employment of foreigners or for paying less than the statutory wage; no convictions for illegal use of child labour or human trafficking; no tax, fee or environmental charge arrears, or social security contribution arrears in the country of establishment; and no relevant international sanctions status that would prevent the contract from being awarded. The contracting authority may also exclude a tenderer if it has seriously or repeatedly breached earlier public contracts or has submitted false information or failed to provide required qualification documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 200,000. If the bidder’s financial year does not coincide with the calendar year, this requirement applies to the last three completed financial years. At least six months must have passed since the end of the last completed financial year by the time the tender is submitted. The bidder must provide an extract from the financial statements for the last three completed financial years, or another proof available to the contracting authority, showing the net turnover. If the bidder acts as an intermediary, it must have a document from the manufacturer confirming the right to supply the goods; if the bidder is the manufacturer itself, it must provide a written confirmation to that effect.
