Compliance requirements
The contracting authority will exclude a bidder if any mandatory exclusion ground applies: conviction of the bidder or its management/representation/control persons for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences, money laundering or terrorist financing; conviction for enabling illegal employment of a foreign national or violating the conditions for employing a foreign national in Estonia, including payment of wages below the statutory minimum; conviction for illegal use of child labour or human trafficking; tax, environmental charge, social security or similar payment arrears in the bidder’s home country; or if the bidder or a management body member is subject to an international sanction, unless concluding the contract would not breach that sanction. The contracting authority may also exclude a bidder if it has materially or repeatedly breached a previous public contract, leading to termination, withdrawal, price reduction, damages or a contractual penalty, or if it has submitted false information about compliance with qualification requirements or failed to submit required additional documents. The machine-readable notice did not include any other precise exclusion grounds; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 200,000 per year. The bidder must submit an extract from the financial statements for the last three completed financial years showing the turnover; for a bidder registered in Estonia as a legal person, this does not apply if the data are publicly available to the contracting authority from a register. If the bidder’s financial year does not coincide with the calendar year, the turnover requirement applies to the last three completed financial years. At least six months must have passed since the end of the last completed financial year by the bid submission date. The bid must include Form 1 (price table) and Form 2 (questionnaire for 110 kV bushings). The bidder must provide the names, job titles and contact details of the contract signatory or signatories, and the name, job title, email address and telephone number of the contact person for contract performance. If signing authority does not arise from the articles of association, a power of attorney must be included. If the bidder is a joint bid, a joint power of attorney must be attached. The bidder must be ready to use Elektrilevi’s Partner Portal (EPP) for contract performance. The bidder must confirm that the bid complies with the tender documents and, where relevant, that equivalence has been explained and supporting evidence has been attached. If the bidder acts as an intermediary, it must have the manufacturer’s document proving the right to supply the goods; if the bidder is the manufacturer, it must provide a written confirmation of that fact.
