Compliance requirements
The tender documents include mandatory exclusion grounds. A bidder must confirm that neither the company nor its management, administrative or supervisory body members, nor any person authorised to represent, decide for, or control the company, has been finally convicted in the last five years for offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or that any exclusion period set in the judgment still applies. If an exclusion ground exists, the bidder may be allowed to show self-cleaning measures, and the official tender documents must be checked for the exact conditions.
Qualification criteria and exclusion grounds
The bidder must hold an operating licence under Section 8 of the Food Act issued by the Agricultural and Food Board. Before contract award, the contracting authority may verify the licence in a public register or request evidence from the bidder. For technical and professional capacity, the bidder must have at least 1 properly performed or ongoing catering contract in a kindergarten or general education school during the 36 months preceding the start of the procurement, with a value of at least EUR 50,000 excluding VAT. The bidder must provide the contract value, signing date and details of the other contracting party. As a compliance requirement, the bidder must inspect the Viiratsi School premises, equipment and furnishings before submitting the bid and complete the on-site registration sheet. The bidder must also submit a two-week sample menu for school lunches and snacks, a two-week sample menu for kindergarten children, and a pricing schedule in the prescribed form. The bid must comply with the tender documents, and conditional bids are not allowed. The precise requirements must be checked in the official tender documents if anything is missing from the machine-readable notice and selected documents are incomplete or truncated in the source text. The machine-readable notice did not include precise requirements; they must be checked in the official tender documents or tender documents.
