Compliance requirements
The bidder must not be subject to any exclusion ground under Section 95(1) of the Estonian Public Procurement Act. This includes participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, financing of terrorism, illegal employment of foreign workers, illegal use of child labour, and human trafficking.
The bidder must not have tax, fee or environmental charge arrears, and must not owe taxes or social security contributions in its country of establishment. Concluding the contract must not breach an international sanction or a sanction of the Government of the Republic.
If the bid is submitted together with a foreign company, or if reliance, a joint bid or subcontracting is used, the bidder may need to submit documents proving the absence of exclusion grounds for those persons as well. For a foreign company, the contracting authority may request additional evidence concerning the company and the members of its representative, management or supervisory bodies.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 3,000,000 excluding VAT, with at least EUR 1,000,000 in each year. If the bidder is not a legal entity registered in Estonia, or if the contracting authority cannot verify the information from public sources, it may request annual report extracts or other evidence. Joint bidders may rely on each other’s figures.
The bidder must have properly performed at least 2 travel service contracts during the 36 months preceding the start of the procurement, with a value of at least EUR 1,000,000 excluding VAT per contract. A contract may have started before that 36-month period and does not need to have ended by the date of the contract notice, but the required service must have been provided in the required period for at least EUR 1,000,000. If needed, the bidder must provide reference contract details, customer contacts, periods and values, and the contracting authority may request a customer confirmation or other evidence.
The bidder must also submit proof of a valid IATA accreditation, CVs and copies of CTC or equivalent certificates for at least 3 travel consultants certified by IATA or an equivalent travel agency. These travel consultants must have at least 2 years of experience as business-client consultants in an IATA or equivalent travel agency and must have Estonian language skills at C1 level.
In addition, a bid security of EUR 5,000 must be submitted, valid for the bid validity period and for 30 calendar days after it, or a deposit must be made to the contracting authority’s bank account. If the bid is signed by an authorised representative, a power of attorney must be provided. If the bidder participates as a joint bidder, the joint-bid power of attorney and confirmation must be submitted. If the bidder is a foreign company, a commercial register extract or another document proving representation rights may be required, as well as evidence that exclusion grounds do not apply.
