Compliance requirements

The contracting authority will exclude the bidder or candidate if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent, decide for, or control the company, has been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, a terrorist offence or an offence related to terrorist activity, incitement, aiding or attempting such an offence, money laundering, or terrorist financing. Exclusion also applies if such persons have been convicted for enabling work for a foreign national staying in the country without legal basis, or for violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate. The bidder is also excluded for convictions related to illegal use of child labour or human trafficking. In addition, the bidder is excluded if it has tax, fee or environmental charge arrears under Estonian law, or tax or social security contribution arrears under the law of its country of establishment. The bidder is also excluded if awarding the contract would breach an international sanction or a sanction of the Government of the Republic under the International Sanctions Act. The notice requires a confirmation that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must prove its ability to perform the contract in at least one of two ways. First, the bidder must have at its disposal the financial resources needed to perform the contract in the amount of at least EUR 150,000; this must be evidenced by a bank statement confirming that the bidder has free funds of at least EUR 150,000 on its account. Second, the bidder’s equity as of 30 April 2026 must be at least 25% of the balance sheet total, but not less than EUR 150,000; this must be evidenced by a free-form statement describing compliance with the requirement together with a balance sheet signed by the bidder’s legal representative as of that date. The bid must include an authorised representative of the bidder who will communicate with the contracting authority and provide clarifications if needed, as well as the person responsible during contract performance, namely the contractor’s project manager. The bidder must have, within the previous 240 months, experience of at least two pipeline construction projects in a single trench under an asphalt-covered street, where the minimum water pipe diameter was De 110 and the minimum gravity pipe diameter was De 200, with a constructed section of at least 150 m. The proof must state the client details, site location, time of performance and confirmation that the works were carried out properly and in accordance with good construction practice. If the bidder relies on a subcontractor’s references, it must show that the person with the required experience will personally perform the relevant part of the contract. When submitting the bid, the bidder must confirm that the bid complies with the tender documents, and conditional bids are not permitted. The bid form must also be submitted in the required format and document form.
