Compliance requirements
The contracting authority will exclude a bidder if any mandatory exclusion ground under Section 95(1) of the Public Procurement Act applies, including convictions for organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing; unlawful employment of foreigners or breach of foreign workers’ employment conditions; child labour or human trafficking; tax, duty or social security arrears; or being subject to an international sanction where contract award would breach that sanction.
The contracting authority may also exclude a bidder if any optional exclusion ground under Section 95(4) applies, including serious or persistent breach of a previous public contract that led to termination, withdrawal, price reduction, damages or a contractual penalty, or if false information was provided about compliance with qualification requirements or required additional documents were not submitted.
The bidder must confirm that none of these exclusion grounds apply. If the exact exclusion grounds are not fully clear from the machine-readable notice, they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have a valid waste permit issued by the Environmental Board for the transport of hazardous waste in all Estonian counties except Saare and Hiiu counties, and must provide confirmation including the waste permit registration number. For Lot 1, the permit must cover all Estonian counties except Saaremaa, Hiiumaa and Prangli; for Lot 2, it must cover Harju, Saare and Hiiu counties.
The bidder must have valid professional liability insurance with a minimum indemnity limit of EUR 20,000 per claim. The insurance must cover claims by the contracting authority and third parties arising from the bidder’s or its employees’ acts or omissions in performing the obligations.
The bidder must have experience in providing hazardous waste collection and transport services. A list of the main contracts completed within the 36 months before the start of the procurement must be submitted; the contracts may have started earlier, but must have been completed. The list must include the contract value, signing dates and information about the other contracting parties.
The bidder must submit a copy of a certificate showing compliance with ISO 9001:2015 (or equivalent) for the quality management system.
